Defending Against Driver's License Suspension

Driver's license suspension is a surprisingly complex issue. While many people recognize it as a criminal penalty associated with drunk driving, traffic violations and other offenses, it can also be a civil penalty. In fact, it is necessary to fight on two fronts to protect your privilege to drive. This is common in DUI cases.

In DUI cases, if you blow over .08, submit to a blood/urine test revealing illegal drugs or over 5 nanograms of cannabis (and in some cases over 10 nanograms of cannabis, depending on substance tested), or refuse testing, you will face an automatic statutory summary suspension that begins on the 46th day after you receive notice. This is entirely separate from the criminal charge and not contingent on you being convicted of DUI. This suspension can be fought in a civil hearing that must be requested within 90 days of service of the notice of suspension. Additionally, if class A injuries occur to a victim, the arresting officer may issue a statutory summary revocation.

If you are actually convicted of the DUI, you will face driver's license revocation as a criminal penalty. The length of the suspension or revocation will depend upon testing and any prior DUI suspensions or dispositions.
